General Terms & Conditions

1. Definitions

In these Terms, the following terms have the meaning set out below:

• "Website" means the website available at https://eternalrent.com and all of its sub-pages.
• "Services" means vehicle rental, reservations, the user account, the loyalty program, and any other services we offer through the Website or at our office.
• "User", "you" or "your" means any person who accesses the Website or uses our Services.
• "Renter" means a person who enters into a vehicle rental agreement with Eternal Pro d.o.o.
• "Reservation" means a request to rent a vehicle submitted through the Website, by phone, by email, or in person.
• "Rental Agreement" means the separate agreement signed when a vehicle is collected, together with all associated rental terms.

3. Eligibility and User Representations

By using the Website and our Services, you represent and warrant that:

• You are at least 18 years old and have the legal capacity to enter into a binding agreement.
• All information you provide to us is true, accurate, complete, and current.
• You will not use the Website or Services for any unlawful or unauthorized purpose.
• For vehicle rental, you meet the additional requirements set out in our Rental Agreement Terms, including the minimum driver age and possession of a valid driver's license.
• You are responsible for all activity that takes place under your user account.

4. Use of the Website

You may use the Website only for lawful purposes and in accordance with these Terms. In particular, you agree not to:

• Use the Website in any way that breaches applicable laws or regulations of Bosnia and Herzegovina.
• Attempt to gain unauthorized access to our systems, servers, databases, or other users' accounts.
• Introduce viruses, malicious code, or any material that is technologically harmful.
• Use automated systems (bots, scripts, scrapers) to collect data from the Website without our written consent.
• Reproduce, duplicate, copy, or resell any part of the Website or Services without our authorization.
• Submit false, fraudulent, or speculative reservations.
• Interfere with or disrupt the operation, security, or integrity of the Website.

We reserve the right to deny access to the Website or to cancel any user account or reservation where we reasonably suspect a breach of these Terms.

5. User Accounts

A user account is not required to rent a vehicle, but it makes it easier to manage reservations and track loyalty points. The following applies to user accounts:

• You may create and use an account with an email and one-time security code, or with your Google account (Google OAuth).
• You are responsible for keeping your login credentials confidential and for all activity under your account.
• You agree to notify us immediately of any unauthorized use of your account or any security breach.
• You agree to provide accurate and complete information when registering and to keep it up to date.
• Each one-time sign-in code expires and can be used only once; authentication and secure processing of sign-in data are handled by our service provider Supabase.
• You may delete your account in Personal details or request help at [email protected]. Deletion does not remove completed or cancelled rental records that we must retain for legal, accounting, insurance or dispute purposes. We reserve the right to suspend or terminate accounts that breach these Terms.

6. Reservations and Formation of Contract

The reservation process through the Website works as follows:

• Submitting a reservation through the Website constitutes your request to rent a vehicle and does not, by itself, form a concluded contract.
• A reservation becomes binding only once we confirm it (by email, phone, or otherwise) and/or upon signing the Rental Agreement when the vehicle is collected.
• We reserve the right to refuse or cancel a reservation, including in cases of vehicle unavailability, suspected fraud, failure to meet driver requirements, or an obvious error in price or description.
• Vehicle availability shown on the Website is indicative and does not guarantee availability until the reservation is confirmed.
• A vehicle shown in a given category is an example; we may provide a vehicle of the same or a higher class depending on availability.

7. Pricing, Availability, and Errors

• All prices are displayed in the currency indicated on the Website and, unless stated otherwise, are quoted for the stated rental period.
• We strive to ensure all prices and descriptions are accurate, but we cannot guarantee that all information on the Website is complete and error-free at all times.
• In the event of an obvious error in price, description, or availability, we reserve the right to correct the error and cancel any reservation based on incorrect information, even after confirmation, with a refund of any amounts paid.
• Prices may change at any time, but changes will not affect reservations that have already been confirmed.
• Possible additional charges and fees are described in detail in our dedicated legal documents.

8. Payment

• Options shown before confirmation may include online payment or payment at pick-up by cash or an accepted credit/debit card. Payment data is processed by the applicable payment service provider; Eternal Pro does not store the full card number.
• A security deposit is required and depends on the selected protection plan. At pick-up it must be provided using only a physical credit or debit card in the main driver’s name; cash, prepaid cards and virtual cards are not accepted. The deposit is neither a deductible nor an overall liability cap.
• Detailed terms for payment, deposits, and refunds are governed by our Payment Terms.

9. Rental Agreement and Related Documents

These General Terms & Conditions apply together with our dedicated documents governing the vehicle rental itself. In the event of a conflict between these Terms and the Rental Agreement regarding a specific rental, the signed Rental Agreement prevails. 10. Intellectual Property

• The Website and all of its content — including text, logos, trademarks, graphics, photographs, design, layout, and software — are owned by Eternal Pro d.o.o. or used under appropriate authorization and are protected by applicable intellectual property laws.
• You are granted a limited, non-exclusive, revocable license to access and use the Website for your own, non-commercial purposes.
• You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Website without our prior written consent.
• The name "Eternal Pro", the logo, and related marks are our marks; their use without authorization is not permitted.

11. User Content and Reviews

• If you leave a review, rating, comment, or other content, you warrant that you have the right to post it and that it does not infringe the rights of third parties or applicable laws.
• By posting content, you grant us a non-exclusive, royalty-free, transferable right to use, display, and reproduce that content for the purpose of promoting and improving our Services.
• We reserve the right to remove any content that is offensive, unlawful, misleading, or otherwise inappropriate, without prior notice.

12. Third-Party Links and Services

The Website may contain links to third-party websites and services that we do not operate (e.g. maps, authentication, analytics). We assume no responsibility for the content, policies, or practices of third parties and give no warranties in respect of them. Your use of such sites and services is at your own risk and subject to their terms.

13. Privacy and Data Protection

We process your personal data in accordance with our Privacy Policy and Cookie Policy, which form an integral part of these Terms. Please read them carefully to understand how we collect, use, and protect your data.

14. Availability of the Website

• We strive to keep the Website continuously available but do not guarantee it. The Website is provided on an "as is" and "as available" basis.
• We may temporarily suspend, withdraw, or restrict access to the Website for maintenance, upgrades, or other operational reasons, without prior notice.
• We are not liable if the Website is unavailable at any time or for any period for any reason.

15. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Website and the information on it are provided without any express or implied warranties as to accuracy, completeness, reliability, or fitness for a particular purpose. This disclaimer does not affect your statutory rights as a consumer under mandatory law, nor any warranties relating to the vehicle rental service itself, which are governed by the Rental Agreement.

16. Limitation of Liability

To the fullest extent permitted by applicable law:

• We are not liable for any indirect, consequential, or incidental damages, lost profits, loss of data, or loss of opportunity arising from the use of or inability to use the Website.
• We are not liable for damage caused by technical faults, interruptions, viruses, or unauthorized access to the Website beyond our reasonable control.
• Our total liability to you in connection with your use of the Website will not exceed the amount, if any, you paid for the relevant service.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under the mandatory law of Bosnia and Herzegovina. Liability relating to the vehicle rental itself is governed by our Insurance & Liability document and the Rental Agreement.

17. Indemnification

You agree to indemnify and hold harmless Eternal Pro d.o.o., its owners, employees, and agents from any claims, losses, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your unlawful use of the Website or Services, or your infringement of the rights of third parties.

18. Force Majeure

We are not liable for any failure or delay in performing any obligation if it is caused by circumstances beyond our reasonable control, including but not limited to acts of nature, fire, flood, war, terrorism, strikes, supply interruptions, failures of telecommunications or power networks, and decisions of competent authorities.

19. Changes to These Terms

We may amend these Terms at any time. The amended Terms will be posted on this page with an updated date. Your continued use of the Website after the changes are posted constitutes your acceptance of the amended Terms. We recommend that you review this page periodically. Reservations already confirmed are subject to the terms in force at the time of confirmation.

20. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable, while all remaining provisions remain in full force and effect.

21. Entire Agreement, Waiver, and Assignment

• These Terms, together with the documents they reference, constitute the entire agreement between you and Eternal Pro d.o.o. regarding the use of the Website.
• Our failure to enforce any right under these Terms in a particular case is not a waiver of that right in the future.
• We may assign our rights and obligations under these Terms to a third party; you may not assign your rights and obligations without our prior written consent.

22. Governing Law and Jurisdiction

• These Terms, and any disputes or claims arising from them, are governed by and construed in accordance with the laws of Bosnia and Herzegovina.
• Any disputes arising out of or in connection with these Terms will be resolved before the competent court in Bosnia and Herzegovina.
• If you are a consumer, this does not affect your mandatory rights under consumer protection law.

23. Eternal+ Rewards Program

Eternal+ Rewards is our free loyalty program. By joining and using the program, you accept the following rules, which form an integral part of these Terms:

• Membership is free and available to individuals aged 18 or over who create a user account. The program is for personal, non-commercial use only and is not transferable.
• The program uses two types of points, both earned after each eligible reservation is marked COMPLETED (not at booking): status points (which determine your tier) and rental points (which you spend). For every €1 of the qualifying amount you earn 1 status point and rental points. The qualifying amount is the post-discount car price plus the selected protection plan, capped at the amount paid. Mileage options, add-ons, cross-border charges, delivery, taxes, fees and the refundable deposit do NOT count.
• Rental points are additionally multiplied by your tier: Gold ×1.0, Platinum ×1.25, Diamond ×1.35, President's Circle ×1.5 (for example, a rental with a €300 earning base gives 300 status points and 375 rental points at Platinum).
• Points have no monetary value, cannot be exchanged for cash, and cannot be transferred to another person or account.
• You redeem rental points at checkout as a discount on the car rental price, at a value of 50 points = €1. On any single reservation, points may cover at most a set share of the car price, depending on your tier: Gold 10%, Platinum 15%, Diamond 20%, President’s Circle 30%. Redemption is available on rentals of any length and may be combined with cash payment (part points, part cash). Points cannot be applied to taxes, fees, protection packages, add-ons, cross-border fees, deposits, fines, damage charges, or third-party services. Redeeming points does NOT affect your tier.
• The program has four tiers, determined by the STATUS points you earn in the current calendar year: Gold (from 0 — the entry tier and permanent floor), Platinum (from 2,000 status points), Diamond (from 4,000 status points), and President's Circle (from 6,000 status points).
• Status is measured per calendar year (1 January – 31 December). Qualifying for a tier in one year keeps that tier for the rest of that year and all of the following year; after that your tier is set by the following year's activity, with Gold as the minimum. Higher tiers carry additional benefits (a higher rental-point multiplier, member rates, a free additional driver, priority pickup, and vehicle upgrades when available), as shown in your account and subject to change.
• Rental points are valid for 24 months after the end of the calendar quarter in which they were earned, and then expire. Status points are valid within the calendar year (subject to the tier-retention rule above). Expiry dates and points expiring soon are shown in your account; expired points cannot be reinstated.
• If a completed reservation is later cancelled or its status changes, the points earned are reversed. If points were redeemed on a reservation that is cancelled, the redeemed points are returned to your account.
• Member benefits (including member rates and discounts) apply only to reservations made through your account and cannot be combined with other offers unless expressly stated.
• We reserve the right to modify or discontinue the program, its tiers, perks, earning and redemption rules, or points validity at any time, by posting the changes. We will make reasonable efforts to protect benefits already earned, in accordance with the law.
• We reserve the right to void points, suspend or terminate membership, and withdraw benefits in the event of program abuse, fraud, provision of inaccurate information, or breach of these Terms.
• Closing or deleting your user account ends your membership and forfeits all unused points and benefits, with no right to compensation.
