Overview
These exclusions and uncovered costs apply to all four protection plans/options to the extent stated for each plan. Third party insurance (statutory third-party liability insurance) is included with every plan, but it does not cover the rental vehicle or remove the renter’s liability for uncovered amounts or recovery claims.
General Exclusions and Uncovered Costs (non-exhaustive)
Other costs
Zero liability applies to damage to and theft of the rental vehicle. "Other costs" are never covered by any protection plan and always remain the renter's responsibility — these include cleaning charges, lost or damaged personal possessions, expenses related to flight or accommodation bookings, fuel and late-return charges, traffic fines and their administration fees, loss of vehicle documents or keys, towing and recovery caused by a breach of the rental agreement, and any loss falling under the exclusions below.
Negligence
Damage resulting from careless or irresponsible behavior.
Violation of Rental Agreement
Any damage occurring as a result of actions that violate the terms of the rental agreement.
Illegal Activities
Damage or loss while the vehicle is used for illegal purposes.
Driving Under the Influence
Any incident occurring while the driver is under the influence of alcohol or drugs.
Unauthorized Drivers
Damage caused while someone other than the authorized driver(s) listed in the rental agreement is operating the vehicle.
Off-road Driving
Damage from driving the vehicle on unpaved roads or off-road conditions.
Failure to Report or Obtain a Police Report
Failure to report an accident, theft, damage or breakdown to Eternal Pro immediately, leaving the scene, or failing to provide an official police report when required may void contractual cover or a reduction of liability.
Prohibited or Unapproved Use
Racing, testing, towing, overloading, carriage for hire, dangerous cargo, use outside the permitted territory or rental period, and cross-border travel without prior approval.
Wrong Fuel and Mechanical Misuse
Damage caused by using the wrong fuel, continuing to drive after a warning or breakdown, disregarding Eternal Pro instructions, or otherwise misusing the vehicle.
False Information, Keys, Documents and Equipment
Loss of or damage to keys, documents and equipment, and damage connected with false information about identity, address, driving licence or the circumstances of an incident, are not covered by a protection plan.
Consequences
An excluded activity, breach of the agreement, or failure to meet reporting duties may void contractual cover or a reduction of liability and make the renter liable for the full amount of damage, loss, recovery, loss of use and related costs, to the extent permitted by law. The statutory rights of injured third parties remain governed by mandatory law and the insurance policy; payment to a third party does not prevent a possible recovery claim against the renter.
